Trade Facilitation

Overview

Trade facilitation as a key driver of economic development and regional integration is crucial in the realisation of ASEAN as a single market and production base. 

 

During the 38th Meeting of ASEAN Economic Ministers (AEM) on 22 August 2016 in Kuala Lumpur, the Ministers agreed to establish ASEAN Trade Facilitation Joint Consultative Committee (ATF-JCC) to give more emphasis on trade facilitation. This strategy enables ASEAN to reduce trade transaction costs, enhance its competitiveness, contribute towards the goal of integrating ASEAN into one seamless market for goods, services and investment and encouraging the establishment of more production network in the region. As part of the initiative to streamline sectoral bodies under purview of Senior Economic Officials Meeting (SEOM) and as per decision of SEOM 3/42 in 2011, ATF-JCC was deferred and pending issues of ATF-JCC were taken up by the Coordinating Committee on the Implementation of ATIGA (CCA).

 

However, ATF-JCC was revived by the 21st AEM Retreat in 2015 to support the ASEAN Trade Facilitation Framework (ATFF). ATFF is a tool to foster greater trade facilitation initiatives and renewed impetus towards trade facilitation within the ASEAN region. It provides a coordinated effort to work towards the twin goals of reducing trade transaction costs by 10% by 2020 and doubling intra-ASEAN trade between 2017 and 2025. Moreover, ATFJCC also covers the key following areas:  

 

  1. Coordinate with relevant ASEAN sectoral bodies playing a role vis-à-vis trade facilitation and its implementation; 

  2. Engage with relevant stakeholders including private sector, academic institutions, international organisations, and other relevant development partners to promote the exchange of information and generate feedback, inputs or proposals on ASEAN trade facilitation measures;

  3. Monitor the implementation of ATFF and trade facilitation measures/initiatives undertaken by the relevant sectoral bodies with ASEAN trade facilitation indicators against which the performance of trade facilitation implementation at national and regional levels can be measured and improved; and

  4. Support the acceleration and deepening of the implementation of trade facilitation measures in the AMSs

 

The ATF-JCC also serves as a focal point to strengthen regional cooperation by promoting, coordinating and collaborating on policies, recommendations, action plans and the implementation of trade facilitation mechanisms. All of which leads to reduced trade transaction costs and increased time efficiency while also ensuring the effective achievement of trade policy in ASEAN. The elimination of trade distorting effects of NTMs in the region are undertaken by the relevant ASEAN sectoral bodies as provided in the Guidelines for the Implementation of ASEAN Commitments on NTMs on Goods (NTM Guidelines). Steady progress has been made in the validation and listing of Non-Tariff Measures (NTMs) onto the ASEAN Trade Repository (ATR).


New features have been developed to promote the utilisation of the ASEAN Solutions for Investments, Services, and Trade (ASSIST). A new e-Platform for Consultations with the Private Sector (ePlatform) has also been developed and is currently on its pilot stage. This new platform is expected to improve, simplify and render more efficient, effective and expedited process of consultations between the ASEAN Secretariat, relevant ASEAN Sectoral Bodies and ASEAN Business Advisory Councils. The platform is due to launch by the 2nd quarter of 2020.

Areas of Cooperation

In line with ASEAN commitments to trade facilitation, ATF-JCC works to further support the AEC 2025 Trade Facilitation Strategic Action Plan (ATF-SAP). It aims to address non-tariff barriers highlighted in the 33rd AFTA Council Report and continue to work towards achieving 10% reduction of trade transaction cost by 2020 and doubling intra-ASEAN trade between 2017 and 2025.

 

ATF-JCC is also supported by the ASEAN Seamless Trade Facilitation Indicators (ASTFI) which has been initiated to work towards a more systematic and robust method in measuring the attainment of the goals as well as to measure the cost of trading across borders in ASEAN. This includes a Time Release Study (TRS) and by gathering data on port dwell times and time to permit approval. These measures provide a detail baseline information for future work on reducing the costs of trading in the region.

 

ATF-JCC, in coordination with the CCA, ASEAN Coordinating Committee on Standard and Quality (ACCSQ) and the ASEAN Committee on Sanitary and Phyto-Sanitary (AC-SPS), is also tasked to monitor the implementation of the NTM Guidelines to ensure greater transparency of trade regulations and procedures initiatives in the region through the operationalisation of ASEAN Trade Repository (ATR).

 

ATF-JCC works closely with the Coordinating Committee on Customs (CCC) and Transport Facilitation Working Group (TFWG) on the WTO Trade Facilitation Agreement (WTO TFA) implementation, especially on Categories B (requiring transitional period) and C (requiring transitional period and technical assistance). The works also include coordination with the ASEAN Coordinating Committee on e-Commerce (ACCEC) to facilitate the upgrading customs clearance for the international shipping of e-commerce products.

At the 21st AEM Retreat in 2015, the Minister agreed to revive the ATF-JCC

Matrix of Actual Cases (MACs)

Strengthened notification of draft measures or actions which may directly or indirectly nullify or impair any benefit to other ASEAN Member States (AMS), or impede the attainment of any objective in accordance with Article 11 of the ASEAN Trade in Goods Agreement (ATIGA) and the Guidelines for the Implementation of ASEAN Commitments on Non-Tariff Measures on Goods (NTM Guidelines) has been set as one of the 2021 Priorities related to Trade in Goods of the ASEAN Economic Community (AEC). It also forms part of a holistic approach to addressing unnecessary NTMs, which is one component of the Broad Strategy 3 (Maximising the Potential of Intra-ASEAN Market and Broader Economic Integration) under the Implementation Plan of ASEAN Comprehensive Recovery Framework (ACRF).

 

As required by paragraphs 1 and 3 of Article 11 of the ATIGA:

 

1. Unless otherwise provided in this Agreement, Member States shall notify any action or measure that they intend to take:
(a) which may nullify or impair any benefit to the other Member States, directly or indirectly under this Agreement; or
(b) when the action or measure may impede the attainment of any objective of this Agreement.

 

2. A Member State shall make a notification to Senior Economic Officials Meeting (SEOM) and the ASEAN Secretariat before effecting such action or measure referred to in paragraph 1 of this Article as attached. Unless otherwise provided in this Agreement, notification shall be made at least sixty (60) days before such action or measure is to take effect. A Member State proposing to apply an action or measure shall provide adequate opportunity for prior discussion with those Member States having an interest in the action or measure concerned.

 

In addition, paragraph 21 of the NTM Guidelines also requires the ASEAN Member States to extend their respective World Trade Organisation (WTO) notifications to the SEOM through the ASEAN Secretariat. The ASEAN Secretariat shall provide copies of the notifications to the ASEAN Trade Facilitation Joint Consultative Committee (ATF-JCC) and the Coordinating Committee on the Implementation of the ATIGA (CCA) for information and reference, and to the relevant ASEAN bodies for appropriate actions.”
